Terms of Service | Luna Your Ai Friend

Welcome to Luna ("we," "our," "us," or "Luna"). These Terms of Service ("Terms") govern your access to and use of the Luna companion application (the "App"), our website, and related services (collectively, "Services"). By accessing or using our Services, you agree to be bound by these Terms. If you do not agree, please do not use our Services.

1. Acceptance of Terms By downloading, installing, or using Luna, you confirm that:

You are at least the minimum legal age in your jurisdiction (13 or 16 years old, depending on your region) or have valid parental consent.
You have read, understood, and agree to comply with these Terms and our Privacy Policy.
You have the legal capacity to enter into a binding agreement.

2. Eligibility & Account

You must provide truthful, accurate information when creating an account.
You are responsible for maintaining the confidentiality of your account credentials.
You must promptly notify us of any unauthorised use of your account.
One account per person. Creating multiple accounts to circumvent restrictions or bans is prohibited.

3. Trial & Subscription Luna offers a discounted trial period for new users. At the end of the trial, your payment method will automatically be charged the full subscription price unless you cancel beforehand.

New users receive access at a reduced trial price for a limited period, as displayed in the App at the time of purchase. Trial duration and pricing may change at any time for new users.
At the end of the trial, billing automatically continues at the standard subscription rate.
Subscriptions renew on a recurring basis (monthly or annually, depending on your selected plan) until cancelled.
You are responsible for any applicable taxes in your jurisdiction.

4. Cancellation You may cancel your subscription at any time through the Settings page within the Luna app. Upon cancellation:

You retain access to the App until the end of your current billing period.
No further charges will be made after cancellation takes effect.
Cancellation does not entitle you to a refund for the current or any prior billing period.

You may also delete your account from within the App. Deleting your account permanently cancels your subscription and removes your data per our Privacy Policy.

5. Refunds All payments are final and non-refundable. Please refer to our Refund Policy for full details, including limited exceptions.

6. Use of the App

Luna is for personal, non-commercial use only, unless otherwise agreed in writing.
You may not resell, sublicense, or commercially exploit any part of the Services.
You agree not to interfere with the App's security or attempt unauthorised access to any systems.

7. Content & Intellectual Property

All intellectual property in the App and Services — including logos, text, code, AI models, and designs — are owned by Luna or licensed to it.
You retain ownership of content you input into the App.
By using the App, you grant Luna a non-exclusive, worldwide, royalty-free licence to use, store, and process your content solely to deliver and improve the Services.

8. Acceptable Use You must not use Luna to:

Engage in illegal, harmful, abusive, or harassing activities.
Transmit viruses, malware, spam, or other harmful data.
Infringe on the intellectual property or rights of others.
Attempt to extract, reverse-engineer, or exploit the underlying AI model or infrastructure.
Impersonate any person or entity, or misrepresent your identity.
Create, store, or distribute any content that sexualises minors or promotes violence.

9. Enforcement & Termination We reserve the right to suspend or permanently ban any account that misuses the platform, violates these Terms, or poses a risk to users or the Services — without prior notice and without refund. We may also terminate your access for any lawful reason at our sole discretion.

10. Disclaimers The App is provided "as is" and "as available," without warranties of any kind, express or implied. Luna does not guarantee that the App will meet your specific needs or operate without interruption, errors, or loss of data.

11. Limitation of Liability To the maximum extent permitted by law, Luna, its affiliates, officers, and employees shall not be liable for any indirect, incidental, consequential, or punitive damages arising from your use of or inability to use the Services.

12. Indemnification You agree to indemnify, defend, and hold Luna harmless from any claims, damages, losses, liabilities, costs, or expenses (including legal fees) arising from your use of the App, your violation of these Terms, or any content you submit.

13. Governing Law & Disputes These Terms are governed by the laws of India, excluding conflict-of-law principles. Any dispute arising under these Terms shall first be attempted to be resolved through informal negotiation. If unresolved within 30 days, disputes shall be submitted to the exclusive jurisdiction of the courts of Mumbai, Maharashtra, India.

14. Changes to Terms We may update these Terms from time to time. We will notify you of material changes via in-app notice or email. Continued use after changes are posted constitutes your acceptance of the updated Terms.

15. Entire Agreement These Terms, together with our Privacy Policy and Refund Policy, constitute the entire agreement between you and Luna and supersede all prior agreements relating to the Services.
