Terms of Service | Luna Your Ai Friend

Welcome to Luna ("we," "our," "us," or "Luna"). These Terms of Service ("Terms") govern your access to and use of the Luna companion application (the "App"), our website, and related services (collectively, "Services"). By accessing or using our Services, you agree to be bound by these Terms. If you do not agree, please do not use our Services.

1. Acceptance of Terms
By downloading, installing, or using Luna, you confirm that:

You are at least the minimum legal age in your jurisdiction (16 or 18 years old, depending on your region) or have valid parental consent.
You have read, understood, and agree to comply with these Terms and our Privacy Policy.
You have the legal capacity to enter into a binding agreement.
You consent to being contacted by Luna via WhatsApp, SMS, email, or other channels for account-related, transactional, and promotional communications. You may opt out of non-essential promotional messages at any time by contacting support.

2. Eligibility & Account

You must provide truthful, accurate information when creating an account.
You are responsible for maintaining the confidentiality of your account credentials.
You must promptly notify us of any unauthorised use of your account.
One account per person and per verified phone number. Creating multiple accounts to circumvent restrictions or bans is prohibited.

3. Trial & Subscription
Luna offers a discounted trial period for new users. The trial duration and price are displayed in the App at the time of purchase and may change at any time for new users.

At the end of the trial, your payment method will automatically be charged the full subscription price unless you cancel beforehand.
Subscriptions renew on a recurring basis until cancelled.
You are responsible for any applicable taxes in your jurisdiction.
Where your purchase is made through a third-party platform such as the Apple App Store or Google Play, billing, payment processing, and any platform-level dispute resolution are governed by that platform's own policies. We encourage you to review them before purchasing.

4. Cancellation
You may cancel your subscription at any time through the Settings page within the Luna app.

If you cancel during a trial period, your access to premium features ends immediately upon cancellation. No remaining trial time is carried over.

If you cancel an active paid subscription, you retain access to the App until the end of your current billing period. No further charges will be made after that date. Cancellation does not entitle you to a refund for the current or any prior billing period.

You may also delete your account from within the App. Deleting your account permanently cancels your subscription and removes your data per our Privacy Policy.

5. Refunds
All payments are final and non-refundable. Please refer to our Refund Policy for full details, including limited exceptions.

6. Use of the App

Luna is for personal, non-commercial use only, unless otherwise agreed in writing.
You may not resell, sublicense, or commercially exploit any part of the Services.
You agree not to interfere with the App's security or attempt unauthorised access to any systems.
Luna's Services are subject to fair use. We reserve the right to throttle, limit, or suspend access to accounts that exhibit automated, scripted, or abnormally high usage patterns, regardless of subscription status. This applies even where the Services are described as unlimited — such descriptions refer to normal personal use and do not permit automated or non-human usage.
Luna's available companions, features, supported languages, and subscription offerings may vary by region and are subject to change at any time.

7. Content, Voice Data & Intellectual Property

All intellectual property in the App and Services — including logos, text, code, AI models, and designs — are owned by Luna or licensed to it.
You retain ownership of content you input into the App.
By using the App, you grant Luna a non-exclusive, worldwide, royalty-free licence to use, store, and process your content solely to deliver and improve the Services.
By using Luna's voice chat feature, you acknowledge that voice recordings from your sessions may be retained and reviewed by our team. We may use both voice and text conversations to improve our AI, services, and products. We do not sell voice recordings or conversation data to third parties.

8. Acceptable Use
You must not use Luna to:

Engage in illegal, harmful, abusive, or harassing activities.
Transmit viruses, malware, spam, or other harmful data.
Infringe on the intellectual property or rights of others.
Attempt to extract, reverse-engineer, or exploit the underlying AI model or infrastructure.
Impersonate any person or entity, or misrepresent your identity.
Create, store, or distribute any content that sexualises minors or promotes violence.
Use automated scripts, bots, or any non-human means to interact with the App.
By signing up, you agree you are not at risk of harming yourself or others. Luna is not a mental health service, and all companions are AI chatbots.

9. Enforcement & Termination
We reserve the right to suspend or permanently ban any account that misuses the platform, violates these Terms, or poses a risk to users or the Services — without prior notice and without refund. We may also terminate your access for any lawful reason at our sole discretion.

10. Disclaimers
The App is provided "as is" and "as available," without warranties of any kind, express or implied. Luna does not guarantee that the App will meet your specific needs or operate without interruption, errors, or loss of data.

11. Limitation of Liability
To the maximum extent permitted by law, Luna, its affiliates, officers, and employees shall not be liable for any indirect, incidental, consequential, or punitive damages arising from your use of or inability to use the Services.

12. Indemnification
You agree to indemnify, defend, and hold Luna harmless from any claims, damages, losses, liabilities, costs, or expenses (including legal fees) arising from your use of the App, your violation of these Terms, or any content you submit.

13. Governing Law & Disputes
These Terms are governed by the laws of India, excluding conflict-of-law principles. Any dispute arising under these Terms shall first be attempted to be resolved through informal negotiation. If unresolved within 30 days, disputes shall be submitted to the exclusive jurisdiction of the courts of Mumbai, Maharashtra, India.

14. Changes to Terms
We may update these Terms from time to time. When we make material changes, we will update the "Last updated" date at the top of this page and may notify you via an in-app notification or a push-based notification. These may include changes to plans with changed limits, prices, or other service changes. Continued use of Luna after changes are posted constitutes your acceptance of the updated Terms.

15. Entire Agreement
These Terms, together with our Privacy Policy and Refund Policy, constitute the entire agreement between you and Luna and supersede all prior agreements relating to the Services.
